User's Acknowledgment and Acceptance of Terms
DESIGN PUBLICATIONS ("Us" or "We") provides the DESIGN PUBLICATIONS websites and various related services (collectively, the "Site") to you, the User, subject to your compliance with all the terms, conditions, and notices contained or referenced herein (the "Terms of Use"), as well as any other written agreement between us and you. In addition, when using particular services or materials on this Site, Users shall be subject to any posted rules applicable to such services or materials that may contain terms and conditions in addition to those in these Terms of Use. All such guidelines or rules are hereby incorporated by reference into these Terms of Use.
These Terms of Use are effective as of 01/01/2020. We expressly reserve the right to change these Terms of Use from time to time without notice to you. You acknowledge and agree that it is your responsibility to review this Site and these Terms of Use from time to time and to familiarize yourself with any modifications. Your continued use of this Site after such modifications will constitute acknowledgement of the modified Terms of Use and agreement to abide and be bound by the modified Terms of Use.
As used in these Terms of Use, references to our "Affiliates" include our owners, subsidiaries, affiliated companies, officers, directors, suppliers, partners, sponsors, and advertisers, and includes (without limitation) all parties involved in creating, producing, and/or delivering this Site and/or its contents.
The Terms
Design Journal, designjournamag.com, Archinterious, archinterious.com, Responsible Design Alliance International, RDA-I, rda-i.org, ADEX, ADEX Awards, Awards for Design Excellence and all associated ADEX Awards emblems are registered trademarks of Design Publications and cannot be reproduced without the expressed written consent of Design Publications.
The terms "User", "Entrant", "Entering Company", "Nominee", "Nominating Company", "Customer" and "Advertiser" are interchangeable within these terms and conditions and refer to persons and companies issued login credentials to websites owned by Design Publications. "Websites" refer to the websites owned and/or managed by Design Publications including but not limited to; designjournalmag.com, adexawards.com, archinterious.com and rda-i.org.
Annual Programs are for companies participating on an annual subscription and billing is automatic. There is a two year minimum commitment for annual programs.
Billing for second competition is six months after the initial order date or January of the following year, whichever comes first and every twelve months after the second billing date as long as you continue. Cancellations after the two competition minimum must be made in writing prior to billing date.
Use of Certificates and Emblems
The use of certificates and emblems applies to all downloaded certificate and emblems from all Design Publications websites including but not limited to; ADEX Nominee Emblem, ADEX Winners Emblems, ADEX Awards certificates, Best of Show emblems and Best of Year emblems, Entering Company is authorized by Design Publications to use the official ADEX Nominee emblems in conjunction with each product nominated in the ADEX Awards competition as long as all entry fees are current. Entering Company may also use the ADEX Nominee logo to publicize its company in general terms. Entering Company may not use the ADEX Nominee logo in conjunction with products not entered in the ADEX competition. Entering Company may use the ADEX Winner emblem and certificate to promote Entering Company's winning product(s) as long as all fees are paid. Should Entering Company win an ADEX Award Entering Company may use the ADEX Winner emblem and certificate for the year in which they were awarded the ADEX in general terms to promote the company. Should Entering Company win an ADEX Award it may not use the ADEX Winner logo and certificate to promote non winning products. The ADEX Awards Entering Company can promote these same rules apply to Best of Show and Best of Year designations.
Use of Websites:
User accepts all responsibility for all content (including text, representations and illustrations) of advertisements, company listings, product listings, project listings, editorial listings, logo listings and any and all other listings submitted and is responsible without limitation, for any and all claims made therefore against Design Publications, its officers or employees.
User is assumed to have the consent of the company he or she is logged into to submit, edit and delete products, projects, editorial and ads on behalf of the company. Design Publications accepts Login credential for companies listed on "Websites" can be issued to multiple persons ADEX Awards
Programs & Subscriptions
All annual sales programs are billed on a subscription basis. Entering Company enrolling in a Single-Brand Annual Program may designate products to nominate for ADEX for only 1 company, division or brand per annual program. Entering Company may not divide nominations among multiple companies, divisions or brands without the consent of Design Publications. Unused entries at the end of Entering Company's contracted term do not rollover to Entering Company's following ADEX term. Design Publications reserves the right to limit products nominated for the ADEX Awards to products released within the previous 18 months prior to the launch of a given year's ADEX Awards competition, which is January 16 of the year products are nominated. All ADEX annual participation programs require a 2 year consecutive participation commitment. Should a Entering Company cancel the 2nd year they must pay the single entry, single competition fee for each product nominated during the first competition in which it enrolled if the amount is more than the annual fee paid. (Example; Entering Company enrolls in an annual program that allows up to 4 nominations for $750 and Entering Company nominates 4 products prior to the renewal date for the next competition. The single entry. Single competition fee is $600. Entering Company in this example owes $1,800 total for the initial competition and thus must pay the balance of $1,800 owed less $750 paid for a total of $1,050 in order to cancel the 2nd year.) Once the 2nd consecutive ADEX competition is completed Entering Company may cancel at any time prior to their annual renewal date. Cancellations must be made in writing to accounting@designjournalmag.com.
All ADEX Awards and Design Publications Annual Programs are typically billed in advance on a subscription basis. The first year is billed at the time the order is placed. The second year is billed in the following January. In the event that a company is allowed to enter after December 31 of the previous year's ADEX Awards competition the second year's program will be billed 6 months after the initial order date so that payment is received prior to the current year's submission deadline. Annual billing is done as a courtesy. In the event an entrant refuses to fulfill the subsequent 2nd billing the annual program shall convert to the single competition rate at the time of the original order and any payments received will be applied toward the new balance and collection fees.
If Entering Company's credit card expires without new expiration date provided by Entering Company or a replacement card be provided, Design Publications shall invoice the Entering Company the annual renewal fee and payment term will be "due upon receipt". All entry fees must be current in order to use ADEX emblems and certificates for promotional use. All products featured on designjournalmag.com and adexawards.com by Entering Company are categorized by Design Publications to the best of its ability. Design Publications, The ADEX Awards and Design Publications accept no liability for the misclassification of Entering Company's products. Misclassified products should be brought to the attention of Design Publications by advertiser either in writing to accounting@designjournalmag.com or by phone to (310) 394-4394 x510. Design Publications will make every effort to correctly classify Entering Company's products. Design Publications will program Entering Company's products to link to each other via hyperlink technology and all posted products shall be accessible from the Entering Company's product page. Design Publications will also provide programmed links to Entering Company's website provided Entering Company has a working website. It is the responsibility of Entering Company to upload its products to the designjournalmag.com and adexawards.com. It is the Entering Company's responsibility to schedule product features either, via designjournalmag.com and/or adexawards.com.
Effective December 01, 2015 the ADEX Single Brand Annual Program (SBAP) $625 has been replaced with ADEX Awards Annual Program (AP) 4 - Nomination $750, all annual programs that are paid on the renewal date will be honoured to continue for as long as the entrant continues to participate. Entrants that do not pay by renewal date will be migrated to the new program ADEX Awards Annual Program (AP) 4 - Nomination $750.
Design Publications shall issue Entering Company a designjournalmag.com and adexawards.com username and password to use for product and company editing, as well as scheduling of features. Each annual ADEX competition will include product nominations for a full year from the enrollment date. Products nominated prior to October 31 will be judged for the current ADEX competition, Products nominated after October 31 through the remaining term will be judged for the following competition. Should Entering Company cancel an annual competition it will automatically forfeit discontinued Annual Program rates and benefits. Upon submitting to ADEX in following years Entering Company will be billed for the current annual program. Entry fees are non-refundable. Should the Entering Company be given the first 2 months free of banner marketing on designjournalmag.com, Entering Company is entitled to the same opportunity for each year it renews. Design Publications will design and produce initial banner ad unless Entering Company supplied a banner of its own design with the entry form. Design Publications will place banner ad(s) in sections(s) of designjournalmag.com deemed best suited for the Entering Company by Design Publications.
Design Publications will reassign banner location and/or replace a banner at any time upon advertiser's written request as long as the new location is of equal or lesser value and space is available. Once initial 2 months of free banner marketing is completed Design Publications reserves the right to bill advertiser either, the monthly amount of one hundred dollars if a valid credit card is on file for the customer with Design Publications, Design Publications or the ADEX Awards, or bill Entering Company a 1-time payment of fifty percent off the total of the remaining ten payments equal to five hundred dollars for the year. It is the responsibility of Entering Company to either, cancel the banner marketing or notify Design Publications that it wishes to convert payment program to month-to-month for the remaining 10 months or Design Publications will assume advertiser wishes to pay the discounted amount of fifty percent off the total of the remaining ten monthly payments. No refunds will be given for unused banner advertising should advertiser cancel either, its annual ADEX Program, its banner marketing or both. Product features are available on a first come, first serve basis and Design Publications assumes no responsibility for scheduling product features. It is Entering Company's responsibility to schedule its product features.
Advertisers and advertising agencies are responsible for all content (including text, representations and illustrations) of advertisements, company listings, product listings, project listings, editorial listings, logo listings and any and all other listings submitted and are responsible without limitation, for any and all claims made therefore against Design Publications, its officers or employees. Design Publications accepts no liability for its failure, for any cause to feature an advertisement on any of its internet websites. Liability for any error appearing in an advertisement is limited to the space actually occupied. No allowance will be granted for any error that does not materially affect the value of the advertisement. Allowance for errors are limited to the first insertion and refunds will be given only in the form of a credit towards future advertising. Banner advertising on designjournalmag.com may cancel advertising in writing anytime via email to: accounting @designjournalmag.com. Banner advertising is billed annually. All cancellations will receive a confirmation via reply e-mail. All products featured on designjournalmag.com are classified by Design Publications to the best of its ability. Design Publications accepts no liability for the misclassification of advertiser's products. Misclassified products should be brought to the attention of Design Publications by email to accounting@designjournalmag.com or by phone to (310) 394-4394 #510. Design Publications will make every effort to correctly classify advertiser's products. Design Publications will program products to link to each other via hyperlink technology and to the advertiser's website. It is the responsibility of the advertiser to upload new products to the site as well as link them appropriately. Design Publications reserves the right to restrict the placement of any product and/or company communication it deems distasteful or inappropriate for designjournalmag.com. It is the advertiser's responsibility to schedule product features via designjournalmag.com. Advertiser will either be given a username and password to use for product and company editing, or provide advertiser the opportunity to create its own. Features are available on a first come, first serve basis and Design Publications assumes no responsibility for scheduling product features except as a courtesy. Publisher accepts no responsibility for the quality of advertiser-supplied materials. An advertiser that does not complete a committed schedule will be subject to the short rate less any applicable discount. In the event that action is taken to collect on this contract, the debtor shall be responsible for all costs thereof, including attorney's fees. This agreement shall be governed by and construed in accordance with the internal laws of the State of California U.S.A., without reference to any conflicts of law provisions. It is agreed that performance hereunder has taken place in the Santa Monica judicial district, County of Los Angeles, State of California in the United States of America. The terms of this Agreement shall control over any conflicting terms in any referenced agreement or document. If any provision of this agreement shall be declared by any court of competent jurisdiction to be illegal, void, or unenforceable, the other provisions shall not be affected but shall remain in full force and effect. If the non-solicitation or non-competition provisions are found to be unreasonable or invalid, these restrictions shall be enforced to the maximum extent valid and enforceable. All provisions that logically ought to survive termination of this agreement shall survive.
